Questions presented:

1. Whether the production and sale of firearms in the United States is the “proximate cause” of alleged injuries to the Mexican government stemming from violence committed by drug cartels in Mexico.

2. Whether the production and sale of firearms in the United States amounts to “aiding and abetting” illegal firearms trafficking because firearms companies allegedly know that some of their products are unlawfully trafficked.

Mexico essentially contends that gun makers in the US have enticed cartels to be violent by manufacturing guns and magazines that hold over ten rounds.

Lack of standing. A foreign entity can’t sue a US company for damage by a product used in another country.

You would have thought that should end it right quick.

Anybody can sue anybody for anything anywhere anytime.

Anyone can attempt to do so. You must still have standing.

Ummm ok potato patato. Still a lawsuit is a lawsuit. Just the beginning of it, not an end as you assumed it should be.

Is it really a lawsuit if a court rejects it?

I had a run-in with a guy who was ultimately deemed a vexatious litigator. That was fun...

Did it involve titillating exposures of naked contemp for the court?

LOL, I ain't that lucky. Some guys get to have all the fun.

I will say that the judge had a good line in mine (I'm paraphrasing):

Vexatious Litigator: "I have spent thousands in filing fees and have not seen a dime in any of my actions!"

Judge" "Well, then I think we all know what the problem is..."

It is still a lawsuit but a frivolous one as we so many times. There are under no circumstances I see this as being a successful lawsuit. In fact with the complainants having no standing I think it will be dismissed during pretrial motions. But as long as it's still on the books it is a lawsuit being brought before the court.

This one has been accepted for SCOTUS review. It had to work its way up from district court.

I think we can both agree that it should have never gotten this far.

Aye. Hopefully the court takes this opportunity to reaffirm the PLCCA while they have this one.
