OK,, so I"m glancing at the Plain Dealer and this story below shows up.

Forgetting for a moment that they were caught doing something wrong,, What happens to the money they must pay out?

Here's the story.... but does anyone know where the dough goes?

Plain Dealer fileCLEVELAND, Ohio -- A Kentucky-based pharmaceutical company has agreed to pay a $50 million fine to the federal government to settle complaints that it gave painkillers to nursing home and other patients across the country without prescriptions.

Omnicare Inc.'s settlement with the U.S. Justice Department was announced at 1 p.m. today in Cleveland by Steven Dettelbach, U.S. Attorney for the Northern District of Ohio, and Michele Leonhart, U.S. Drug Enforcement Administration Administrator.

At the news conference, Dettelbach called it the second biggest settlement in the history of the Controlled Substances Act.

Complaints against the company originated in Northeast Ohio.

The settlement resolves complaints made by the Justice Department that Omnicare, among other things:

* Routinely dispensed controlled substances to residents of long-term facilities without a prescription signed by a practitioner.

* Dispensed controlled substances to residents of long-term facilities from prescriptions missing essential elements such as drug name, dosage, strength, quantity, Drug Enforcement Administration number and practitioner.

Omnicare is a Fortune 400 company based in Covington, Ky., and the nation's leading provider of pharmaceutical care for seniors. It serves, on a daily basis, 1.4 million residents of skilled nursing, assisted living and other healthcare facilities in all 50 states and the District of Columbia.

The same thing that happens to all money given to the federal government. It goes in worth a dollar and comes out worth about ten cents.

I recognize that 50 million is a drop in the bucket as it relates to the national debt, and I expect that some of that money goes to cover the costs of prosecuting the company.. no doubt.. But shouldn'/t the rest to towards our debt?

And that's really what I'm asking.. sorry if I wasn;t' clear

I doubt it.

I assume that there is a specific fund that this will go into that will help pay for other prosecution cases in the future. That's my best guess at least.

The same as all fines paid to any government, it becomes a credit on the ledger in the General Fund.
That's it, and I'm pretty sure that the GAO actually has rules stating as much.

To the topic of what happened from a nurse, me.

Recently the DEA has gotten really strict with its policies. Where I use to be able to get a telephone order from an MD, write it out, then send it to the pharmacy for fill. I now have to have the doctor actually sign the order before it gets filled. Sounds fair, right? It becomes very problematic when I have a patient in a severe pain crisis and I call the doctor for orders but he doesn't have access to a fax machine for an extended time. Which happens regularly. Now my patient is left twisting in the wind until the doctor can get to the fax. It sucks. Some pharmacies have played a little loose with the recent rule changes. Having humanity in times of real need. This one got busted.

To add...
Long term care facilities (nursing homes) have what's called an E Kit. An emergency kit of crucial medications, narcotics included. This allowed for a patient that maybe had a fall one morning causing an injury, to get something like a Vicodin on board directly after the fall. All we had to do was call the doctor. Get the okay, and give the med. This way we wouldn't have to wait for the pharmacy to deliver the med. which takes at about 2 hours even when we'd classify it a 'hot run'. Meaning we need it now.
Those E Kits act as an onsite extension of the pharmacy. Now, we can no longer just pull the med from the kit. Even with the MDs verbal consent/order. The MD must fax the pharmacy before we can pull anything from the kit.
So imagine having to tell a family member that I understand their dad is hurting, and that we have the okay to give a med, and it's in the building...but we can't give it yet. Sorry.
It sucks!

I wonder how much of that is due to the massive fraud that happens or if its some attempt to curb narcotics addiction. I really wish we'd just legalize all drugs.

I bet it goes to lawyers. 50 million dollars, why wouldn't it go to the lawyers.
That or it gets paid out 1 dollar a month for 4000 years.
